Whitetail Hill App Terms of Service

These terms are an agreement between you and WHC Farms LLC, doing business as Whitetail Hill ("Whitetail Hill," "we," "us"), and govern your use of the Whitetail Hill mobile app. By creating an account or using the app, you agree to them.

What the app is

The Whitetail Hill app provides tools for planning and managing wildlife habitat: plot mapping and measurement, seed and tree selection guides, soil test interpretation, sun and wind information, and a direct line to our team. The core app is free to use.

Your account

You're responsible for your account and for keeping your password to yourself. You must be at least 13 to use the app. You can delete your account and all your data at any time in the app (Tools → Account).

Guidance, not guarantees

Our guides and tools offer practical recommendations based on the information you give us — plot size, conditions, your goals, your soil lab's printed recommendations. It's the same advice we'd give you over the phone, but growing things involves weather, soil, browse pressure, and luck we don't control:

- Recommendations are informational. They are not a warranty that any seed, tree, or plan will establish, grow, or produce specific results.
- Soil figures come from your lab. The soil tool scales and translates the recommendations printed on your soil report; it does not generate its own prescriptions. Confirm rates against your report before buying or spreading anything.
- Measurements are estimates. Plot acreage, distances, and map features are based on consumer GPS and satellite imagery and can be off. Verify before making purchases or legal decisions (property lines especially — the app does not show parcel boundaries).
- Weather data is a forecast. Wind and sun information comes from third-party sources (the National Weather Service and astronomical calculations) and can be wrong. Never rely on it for safety decisions.

Purchases

Seed, trees, and supplies are sold through our online stores, and those purchases are governed by the stores' own terms, shipping, and return policies — not these terms. Prices and availability in the app reflect the stores but can lag; the store checkout is authoritative.

Acceptable use

Don't attempt to break, probe, or overload the app; don't use it to infringe anyone's rights; don't scrape or resell its data.

Our content

The app, its design, logos, guides, and content belong to Whitetail Hill and its licensors. Your data — plots, maps, plans — is yours; we host it to run the app for you.

App Store

You get the app through Apple's App Store, and Apple's standard terms apply to the download itself. These terms are between you and Whitetail Hill, not Apple. Apple isn't responsible for the app or its content and has no obligation to provide support or handle claims about it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimers and liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, WHITETAIL HILL'S TOTAL LIABILITY ARISING FROM THE APP WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID FOR THE APP IN THE PAST TWELVE MONTHS (CURRENTLY ZERO — THE APP IS FREE) OR (B) FIFTY DOLLARS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING CROP OR PLANTING FAILURES. Some states don't allow certain limitations, so parts of this may not apply to you.

Changes and termination

We may update the app and these terms; continued use after changes means you accept them. We may suspend accounts that violate these terms. You can stop using the app and delete your account at any time.

Governing law

These terms are governed by the laws of the State of Alabama.
